NLRB Advances Union-Election Amendments

The National Labor Relations Board (NLRB) on Nov. 30 voted to move forward with six proposed amendments to existing procedures for union elections. Supporters say the amendments would reduce election delays by limiting the scope of issues considered during pre-election hearings and consolidating current litigation procedures. However, opponents of the NLRB proposal, including NAA/NMHC, argue that the amendments would deny the rights of both employers and employees by limiting opportunities to raise legal objections and delaying the resolution of certain issues—including whether an employee is eligible to vote in a union election—until after an election has already occurred. The NLRB must approve the finalized proposal by Dec. 31 to implement the changes.
Meanwhile, the House passed a bill (HR 3094) also on Nov. 30 that would largely block the NLRB’s proposal. NAA/NMHC support the measure, although it is unlikely to be approved in the Democrat-controlled Senate.
