Though “card check” legislation is dead in this Congress owing to the Republican majority in the House, labor issues remain prominent on NAA/NMHC’s agenda thanks to a series of pro-union actions by the National Labor Relations Board (NLRB).
One recent proposal, known as the “poster rule,” would require employers to post a workplace notice promoting unionization. The regulation was set to go into effect on Nov. 14 but has been delayed until Jan. 31, 2012, after strenuous objection by the business community, including NAA/NMHC, about the poster’s biased language favoring unions and the Board’s legal authority to promulgate the rule.
According to NLRB, the rule’s implementation was delayed to allow further education and outreach to employers, particularly with regard to confusion among businesses about whether they are covered by the requirement. Legal action to block the regulations is pending.
