Those who teach or represent property managers in fair housing matters often hear owners and executives confidently assert that they’ll be OK even in the event of a fair housing case, "After all, we have insurance!" The reality is that the language of a liability policy may mean that coverage is not provided.  And even if there is coverage, there are many other issues to address. Is legal representation covered?  What about a settlement (and does the property manager or the insurance company make this important decision?)? Do the laws in certain of the States in which the property manager has communities actually preclude the coverage even if it is in the overall policy? Can a property manager lose tax credit status because of a settlement? These are only some of the many questions that should be considered, explored and understood by anyone with responsibilities for risk management in our industry.

According to the 2002 National Survey of Latinos, conducted jointly by the Pew Hispanic Center and Kaiser Family Foundation, the primary language spoken among U.S. Hispanics varies by generational level. Among first-generation Hispanics, 72 percent of Spanish-dominant Hispanics speak Spanish, 24 percent are bilingual and just 4 percent are English-dominant. There is no real surprise in these numbers, for most people. However, among second-generation Hispanics, 46 percent of U.S. Hispanics are English-dominant, 47 percent are bilingual and just 7 percent are Spanish-dominant. These numbers appear to be the inverse of first-generation Hispanics. And finally, among third-generation Hispanics, 78 percent are English-dominant, 22 percent are bilingual and 0 percent is Spanish-dominant.  However there is one motivating factor that remains the common denominator amongst this Hispanic renter – cultural relevance.

Preventing Litigation and Reducing Damages for Environmental Issues in Multi-Family Housing

There are a number of environmental issues that can impact owners and managers of multi-family housing properties.  Many of these issues can have huge financial impacts in terms of repair costs, increases in insurance premiums and even litigation.  A number of insurance companies have begun to limit coverage for a number of these environmental issues, which in turn requires more out of pocket expense for the property owner.  Even when coverage is available for environmental hazards, the insurance companies will most likely require that the property owner demonstrate their ability to plan for, manage and reduce their risk.  Our experience has shown that very few property owners or management companies completely understand the risks they face, how these environmental issues could impact them or how to manager the risk associated with environmental issues.  Upon session completion, participants should have a good foundation to understand the potential risk in their portfolios as well as how to develop meaningful prevention and risk management plans to reduce environmental liability.

Everything is on a tight schedule, and missing the leasing window could mean starting the school year with low occupancy and very little opportunity to recover. Now, however, web-based technology is making high-volume processing periods much easier. New web-based tools are allowing site staff to streamline the move-in and move-out processes, including, floor plan quotes, future availability, roommate grouping, unit swapping, wait listing, renewals, payment options and plans, and lease execution.
