SWANCC is only the second case since the passage of the Clean Water Act (CWA) in which the Supreme Court has addressed the geographic reach of  federal jurisdiction under that Act. In ruling in SWANCC that the United States Army Corps of engineers exceeded that jurisdiction by attempting to regulate non-navigable, isolated waters under its "Migratory Bird Rule," the Supreme Court set forth several principles which require the agencies to cease their attempts to claim jurisdiction over areas and features that are only remotely related to "navigable waters".
