Although mold is a national problem, states are experiencing different effects of the “mold crisis”. For example, in some states the issue of property and liability insurance have created serious disruptions in the real estate market. Since insurance is regulated at the state level, issues that are ripe for consideration include a legislative directive to state insurance commissioners to give specific consideration to the issue of mold, including the availability and cost of insurance products and limiting the scope of pollution exclusion clauses so that they do not apply to mold.
