Thank you for your letter of September 24, 1998, regarding the application of the Fair Housing Act's design and construction requirements to purchasers of multi-family housing buildings. In particular, you ask whether the purchaser of a multi-family housing building or of a I unit within such a building who was not involved in its design or construction could be held liable for the building's failure to satisfy the accessibility requirements of the Fair Housing Act (the Act).
